Digital governance

Navigating the digital era.

Regulatory frameworks related to digitalisation, information management and cybersecurity are continuously evolving in line with digital developments. The wide-ranging changes that are now starting to come into force are predominantly based on new EU regulation in the so-called 'digital decade'. AI Act, Data Act, DGA, NIS2, DSA, DMA, CRA, CER, DORA etc. The abbreviations are many! These regulations cover issues such as cybersecurity, liability for digital services, online content and issues related to AI, and affect most organisations operating in the connected world, whether in the form of services or products.

Managing Risks
Digital Governance is about managing risks and ensuring compliance with regulations and is essential for organisations to successfully navigate the digital era.

Digital Governance covers several areas:

Digital strategy: A comprehensive plan that identifies how the organisation will use digital resources to achieve its objectives.

Governance: A framework that establishes responsibilities, roles and decision-making processes to ensure that digital initiatives and resources are managed in a coordinated and efficient manner.

Data management: ensuring that the organisation collects, stores, manages and uses data in a secure and efficient way.

IT architecture: The design of an organisation's IT infrastructure and systems to support business objectives and processes.

Technology management: managing and evaluating technology choices to support the organisation's needs and strategies.

Project and portfolio management: To effectively plan, monitor and manage various projects and initiatives within the organisation, such as implementing AI or new business models, in order to maximise performance and achieve strategic objectives.

Compliance - a competitive advantage

In today's rapidly changing world, good compliance is not just a necessity but also a competitive advantage. If your organization, its products, or services are affected by current regulations, it is crucial to evaluate and ensure that you comply with them. At MAQS, we have extensive experience and expertise in analysis, risk management, and strategic support. We address issues that are not only legal but also organizational and technical. Through close collaborations with leading partners in technology and security, we can offer comprehensive support and help your organization navigate the complex environment of digital regulations.

MAQS has developed several processes to assist our clients with legal advice on their path to compliance with digital regulations such as the AI Act, Data Act, DORA, NIS2, and more. These processes form the basis of our work but are tailored to your needs and operations.

Introduction and assessment of scope

The first step towards ensuring compliance is to assess whether your business is covered by the relevant regulation. The work begins with a meeting to gain a deeper understanding of your business and determine if more information is needed. In the next step, MAQS will assess whether you are covered by the regulation and recommend measures to proceed with the work.

MAQS can also offer a more comprehensive introduction to the regulatory requirements through training and other initiatives if desired. We also offer additional legal advice and support in identifying business opportunities and impacts on your operations as part of the continued work below.

Workshop and gap analysis to achieve your goal

In this step, we conduct a joint workshop to introduce the regulation and raise awareness of its requirements. In conjunction with this, we also conduct a current state analysis through meetings with relevant stakeholders and review existing documentation and routines. Together with you, we also define a goal. MAQS then compiles a gap analysis in a report that contains recommended measures to achieve your goal where we have identified gaps. We review the report with you to discuss how you want to address identified deficiencies and establish an activity and project plan to achieve your goal.

Once the above process steps have been completed, MAQS also offers legal advice for the implementation and management of the recommended processes, strategies, and measures. This advice can either be integrated as an additional step in the existing project or carried out as a completely separate assignment.

Together, we can ensure that you meet the necessary requirements and leverage them to strengthen your brand and business opportunities. Contact us for a non-binding conversation about how we can work together to maximize your digital potential.
